Violation of immigration laws

Immigration law violations are often investigated directly by the Immigration Office. In order to detain a person in a criminal case, a warrant issued by a court judge is required, so if it is not a serious case, the investigation is conducted without detaining the person.
However, the Immigration Office immediately detains foreigners through protection orders, making it difficult to receive appropriate legal assistance during investigations related to violations of immigration laws.
2. How to respond
If a foreigner violates immigration laws, he or she is subject to deportation review. Therefore, you must properly respond to violations of immigration laws through a lawyer, and if you are found to have violated immigration laws, you can only continue to reside in Korea if you convince yourself that there are humanitarian grounds for continuing to reside in the Republic of Korea.
