DEPARTURE ORDER

The Immigration Office may issue a departure order for foreigners subject to deportation, such as when they voluntarily attempt to leave the country or when their visas have been cancelled. A departure order is the same as a deportation order in that you must leave the Republic of Korea, but it has the advantage of being able to terminate your residence in the country without detaining your person.

2. How to respond

Foreigners who have received a departure order from the Immigration Office can contest the unfairness of the departure order by filing a lawsuit in court. If you have filed a lawsuit, you can receive a postponement of the departure period from the Immigration Office and continue to reside in Korea while the lawsuit is pending.
